[olpc-help] Unexpected battery shutdown at 33%

I received my XO on March 18, 2008.  It arrived with the battery 75%  
charged.  I then fully charged it.  When running only on battery my  
XO shuts down suddenly when the battery is discharged 33%.  The red  
warning light does not come on.  When I charge the XO it seems to  
take 100% charge.  When  run on battery only the XO is performing  
with a light load such as opening the browser a few times, looking at  
the journal, terminal and closing and opening the browser.  When I  
plug the XO back in to the power supply the charging light does not  
come on.  I have to take the battery out and plug in the power supply  
and then the power  light blinks orange once.  I can then unplug the  
power supply, put the battery back in, and then plug in the power  
supply and proceed to charge and the power light is orange until  
charging completes. This is a reproducible problem.
Is this a firmware problem that can be fixed with a patch or do I  
need to ask for an RMA ?
