If they are granted a patent then the only way you could distribute code 
  using that algorithm in countries that honor patents is if they 
granted on open license for anybody to use the technology.

Since their goal is to use it for commercial gain I don't see that 
happening.

So no.  The NiMH code will probably never be open.
