 Agreed.  Since you have to actively set the serial say that if that bit is
 set then you _want_ the serial port and therefore the module should fail.
 The "I win" option says yes its ok to load the camera even if the serial
 port is set (say if the jumper is shorted and you don't want to unshort
 it) It would then unset the serial mux and load the driver.
