 assumed fixed by the following patch:

 http://vserver.13thfloor.at/Stuff/OLPC/delta-cow-fix17.diff

 rationale: the issue was caused by a stale (unhashed)
 dentry which resulted in incorrect data being passed
 down to the actual filesystem layer.
